Terms & Conditions of Service

These Terms & Conditions (“Terms”) govern your use of the Shop N Ship website, client portal, and customs brokerage services provided by Shop N Ship Ltd. (“Shop N Ship,” “we,” “us”) in The Bahamas. By opening a client account or engaging our services, you agree to these Terms.
1. Services
Shop N Ship provides licensed customs brokerage services, including import and export clearance, documentation, agency coordination, and related forwarding support. The specific scope of work for each shipment is defined by the documents you provide, our brokerage instructions, and applicable Bahamian law.
2. Client authorisation (C44)
We cannot act as your broker until you have completed a valid C44 client authorisation appointing Shop N Ship as your licensed customs broker. You are responsible for ensuring the authorisation is accurate, current, and filed as required by the Bahamas Customs Department.
3. Click2Clear and government systems
Clients must maintain an active Click2Clear account with the Bahamas Customs Department where required. Registration and access to government systems remain your responsibility; we will guide you during onboarding but cannot file entries on your behalf until you are properly registered and authorised.
4. Your responsibilities
You agree to:
- Provide complete, accurate shipment documents and information in a timely manner.
- Disclose permits, restrictions, or agency requirements that apply to your goods.
- Review and approve duty, VAT, and fee assessments before authorising payment where applicable.
- Keep your account credentials confidential and notify us of unauthorised access.
- Comply with all applicable laws, including customs, tax, and import/export regulations.
5. Fees and payment
Brokerage fees, disbursements, and government charges are presented through your client portal or invoice before you authorise payment, unless otherwise agreed in writing. You are responsible for import duty, VAT, and other assessments determined by the Bahamas Customs Department and partner agencies. Late or declined payment may delay clearance or release.
6. Customs processing and timelines
We work diligently to prepare complete entries and limit unnecessary delays. However, import duty rates, examination outcomes, agency approvals, and release times are determined by the Bahamas Customs Department and partner government agencies — not by Shop N Ship. We do not guarantee customs processing times or examination results.
7. Client portal
Access to the client portal is provided for convenience. Status updates and document displays depend on information available from customs, carriers, and our internal systems. The portal does not replace official customs notices or signed brokerage documents where those are required.
8. Corporate accounts
Corporate account managers are responsible for users they invite to the account. Each authorised user must comply with these Terms. The account manager remains responsible for entries, payments, and actions taken by their team members unless otherwise agreed in writing.
9. Limitation of liability
To the fullest extent permitted by law, Shop N Ship is not liable for indirect, consequential, or special damages, including lost profits or business interruption. Our total liability for any claim relating to a specific shipment is limited to the brokerage fees paid to us for that shipment, except where liability cannot be limited under applicable law.
10. Indemnity
You agree to indemnify Shop N Ship against claims, penalties, or costs arising from inaccurate information you provide, undeclared or misdeclared goods, or your failure to obtain required permits or authorisations.
11. Termination
Either party may end the brokerage relationship in accordance with applicable customs requirements. Termination does not affect obligations for shipments already in progress or records we are required to retain.
12. Privacy
Our collection and use of personal information is described in our Privacy Policy.
13. Governing law
These Terms are governed by the laws of the Commonwealth of The Bahamas. Disputes shall be subject to the exclusive jurisdiction of the courts of The Bahamas, unless otherwise required by mandatory law.
14. Changes
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date. Continued use of our services after changes constitutes acceptance of the updated Terms.
